Fuel Wholesale Depots for Sale – Mpumalanga

A fuel wholesale company with its geographical footprint mainly in Mpumalanga has put up 3 x Storage depots with truck stops for sale in Mpumalanga, excluding the property which is on long term lease. The potential transaction consists of three (3) wholesale depots, each with refuelling facilities, and an average of 2,5 million litres of diesel sales per month. Client payment terms vary from cash to 30 days after statement.

The three depots are strategically based on major transport routes and within the coal belt of Mpumalanga, providing a vital role to surrounding sectors. Clients vary from mines, transporters, and farmers. The depots have a combined storage capacity of about 250 000. The sellers have spent a significant amount of time and capex in setting up these depots to ensure Nersa compliance and safety. The total asset value of all depots is R 5 mill. The 3 depots are all operational for interested parties and will play a significant role once again in security of supply for years to come. Asking price for the 3 depots and COC clients is R50 Million. Nett R 1,230,000 per month.

All rights, consents, NEMA approvals, fire licenses etc. have all been approved. Please note that if you intend purchasing these depots, then you must have the full amount of R50 Million CASH readily available and be able to provide guarantee for the full amount. NO details, information documentation or Site Location will be provided unless (A) you meet the above Financial Criteria, and (B) complete and returned our Confidentiality / Non-Disclosure Agreement. Preference will be given to suitable candidates with sound knowledge based on proven financial and business principles and will be required to be considered for this opportunity. Coupled to this, a candidate will show and provide proof of the necessary cash funds to pay the monies associated with this transaction. The Seller has insisted that only CASH BUYERS will be considered.

Commission

A property practitioner is not entitled to a commission unless he/she is registered and possesses a valid FFC

The following juristic and natural persons are defined by section 1 of the Act as property practitioners, Agents, Business Brokers, Consultants, Advisers, Agency, Accountants, Attorneys, Auctioneers, Bridging Financer, Bond Brokers, Developers, Homeowners Associations, Managing Agents, and Time Shares, (note, without limiting to same).

The Property Practitioners Act came into effect on the 1st of February 2022. Sections 47 and 48 of the Act compel property practitioners including its Directors, Members or Trustees, and all employees who act as property practitioners to obtain and hold a valid Fidelity Fund Certificate (FFC) which must be applied for from the PPRA.

Section 48 of the Act effectively bars a property practitioner from rendering services as a property practitioner if he/she does not possess a valid FFC and Section 56 dictates that a property practitioner is not entitled to commission unless he/she is registered and possesses a valid FFC.

Furthermore, Section 48(4) stipulates that a property practitioner who receives a commission in the absence of the certificate as mentioned above will be required to pay back the commission immediately upon receipt of a written request. Conveyancers are prohibited from paying commissions or monies unless a property practitioner produces a certified copy of their FFC.

The consequence of operating without a fidelity fund certificate is that a property practitioner can be found guilty of an offense in section 48(5) of the Act.
